Supreme Court Refers Gyanvapi, Mathura and Sambhal Disputes to Special Lok Adalat

In a significant move, the Supreme Court has referred three of India's most sensitive religious disputes—the Gyanvapi Mosque case in Varanasi, the Shri Krishna Janmabhoomi-Shahi Idgah dispute in Mathura and the Hari Mandir-Jama Masjid dispute in Sambhal—to a special Lok Adalat for an out-of-court settlement.

The special mediation initiative, titled "Samadhan Samaroh," will be held at the Supreme Court premises from August 21 to August 23. The objective is to encourage dialogue between the parties and explore a mutually acceptable solution instead of continuing prolonged legal proceedings.

Notices Issued to Both Hindu and Muslim Parties

The Supreme Court has issued notices to both Hindu and Muslim parties involved in all three disputes. Before the Lok Adalat proceedings begin, pre-conciliation efforts are already underway to identify possible areas of agreement.

A pre-conciliation hearing in the Gyanvapi case is scheduled to take place in Varanasi on July 14, while mediation in the Mathura dispute had earlier failed, leading to its inclusion in the special settlement process.

The court's latest step is being viewed as an effort to reduce lengthy litigation and promote peaceful resolution through consensus.

What Is the Gyanvapi Mosque Dispute?

The Gyanvapi case relates to claims by Hindu petitioners that the mosque in Varanasi was built after the demolition of the original Kashi Vishwanath Temple during the Mughal period.

The Hindu side has sought the right to worship at specific locations within the mosque complex and has also questioned the applicability of the Places of Worship (Special Provisions) Act, 1991.

The Muslim side, represented by the Anjuman Intezamia Masjid Committee, maintains that the mosque is protected under the 1991 law and has challenged the maintainability of the petitions.

Mathura and Sambhal Cases Also Under Consideration

The Mathura dispute concerns the Shahi Idgah Mosque, where Hindu petitioners claim the mosque was constructed at the birthplace of Lord Krishna after the demolition of an earlier temple. Multiple petitions seek restoration of the land or removal of the mosque, while the mosque committee disputes these claims and cites legal protection under the Places of Worship Act.

The Sambhal dispute began after a court ordered a survey of the Shahi Jama Masjid following claims that a Hari Mandir originally existed at the site. The survey later triggered violence in the area, resulting in casualties and injuries. The legal proceedings remain pending before the Supreme Court.

Focus on Peaceful Resolution

The Supreme Court's decision to refer the disputes to a special Lok Adalat reflects an effort to encourage dialogue in matters involving religious and historical significance.

While participation in the settlement process does not automatically resolve the disputes, it offers both sides an opportunity to reach an agreement outside the courtroom. If no settlement is reached, the cases will continue through the regular judicial process.

Legal experts believe the initiative could help reduce tensions while allowing both communities to present their concerns through structured mediation.
