Supreme Court Seeks Balanced Approach to Delhi-NCR Firecracker Use

The Supreme Court of India has indicated that it wants to adopt a balanced approach to the ongoing debate over firecracker use in Delhi-NCR, stressing that religious sentiments must be respected while wider public concerns are also addressed. During a hearing on Monday, October 12, 2026, a bench led by Chief Justice of India Surya Kant said there was still time to appeal to citizens and explore practical ways to regulate the use of firecrackers. The hearing concerns restrictions on firecrackers in Delhi and the National Capital Region, where air pollution frequently becomes a major concern during the winter months. The period also coincides with several religious and cultural festivals, making the issue particularly sensitive for residents, authorities and environmental advocates. The court made it clear that it did not want to hurt religious sentiments. At the same time, it indicated that a workable solution would need to consider public awareness, civic responsibility and the practical challenges associated with enforcing restrictions.

Supreme Court Questions the Link Between Firecrackers and Religious Freedom

One of the key moments during Monday's hearing came when a lawyer argued that bursting firecrackers should not automatically be treated as an essential part of the fundamental right to religious freedom. The lawyer distinguished between worship as an expression of religious faith and the act of bursting firecrackers during a festival. While religious practices deserve constitutional protection, the argument suggested that the use of firecrackers should be considered separately when examining questions of religious freedom and public interest. During the submission, the lawyer remarked, "Even God would be surprised." The comment was made in the context of the argument that firecracker use should not necessarily be equated with religious worship. Justice Joymalya Bagchi also questioned the connection between firecrackers and religion, asking, "What do firecrackers have to do with religion?"

Why the Court Wants a Practical Solution Instead of a Simple Ban

The Supreme Court also highlighted the practical difficulties that can arise when restrictions are imposed without considering how people may respond. Chief Justice Surya Kant had previously observed that if the court imposed a complete ban on firecrackers in Delhi-NCR, people might start bursting them during daytime instead. The observation reflected a concern about whether a blanket prohibition would necessarily achieve its intended purpose if enforcement remained difficult. This issue is particularly relevant in a densely populated region such as Delhi-NCR, which includes Delhi and adjoining urban areas in Haryana, Uttar Pradesh and Rajasthan. Restrictions covering a large population require coordination between multiple authorities, effective monitoring and public cooperation. During Monday's proceedings, the court suggested that there was still sufficient time to appeal to citizens and consider limiting firecracker use to specific hours.

Public Awareness and Civic Responsibility Take Centre Stage

The Supreme Court emphasised that citizens and civil society should remain aware of the prevailing situation and understand their responsibilities. This emphasis on public awareness is important because environmental regulations often depend on voluntary cooperation alongside enforcement. Residents need to understand why restrictions are being considered, what the rules require and how individual choices can affect the wider community. Firecracker use is a recurring subject of concern during the festive season because it can release smoke and particulate matter into the atmosphere. The impact can be particularly worrying when other pollution sources and unfavourable weather conditions are already contributing to poor air quality. The issue is especially relevant for people who are more vulnerable to polluted air, including children, older adults and those with existing respiratory conditions. The extent of the impact can vary depending on the type and quantity of fireworks used, local conditions and other pollution sources. The court's approach, as reflected in its oral observations, points towards an effort to examine practical options without dismissing either religious sensitivities or environmental concerns.

Delhi-NCR Firecracker Ban Linked to a Long-Running Pollution Case

The current proceedings arise from a case dating back to 2015, in which the Supreme Court issued a series of directions regulating the manufacture, sale and use of firecrackers. The legal action has focused particularly on worsening air quality in Delhi and neighbouring regions. Over the years, the court has considered different measures intended to control the environmental impact of fireworks, including restrictions on their manufacture, sale and use. The issue has remained complicated because Delhi-NCR faces pollution from several sources. Vehicle emissions, construction activity, industrial emissions, road dust and other factors can affect air quality. Firecrackers are another potential contributor, particularly when used in large quantities over a short period. This means that regulating fireworks is one part of a wider environmental challenge rather than a complete solution to the region's pollution problem. The latest hearing continues this legal process, but the final position will depend on the court's formal orders and the evidence placed before it.

What Are Green Firecrackers and Why Are They Important?

Green firecrackers have become a significant part of the debate over whether fireworks can be regulated in ways intended to reduce their environmental impact. These products are designed to meet specified standards intended to reduce certain emissions compared with conventional fireworks. Their actual environmental performance depends on their composition, testing, certification and compliance with applicable requirements. The term "green" does not mean that a firecracker is completely pollution-free or harmless. Such products can still generate smoke, particulate matter and noise. Their use may therefore remain subject to restrictions even when they meet the relevant standards. In the Delhi-NCR context, the legal question is not simply whether a product is marketed as a green firecracker. Its eligibility, approval status and permitted use must be assessed under the applicable rules and court directions.

Barium-Based Firecrackers and the CPCB Report

Another important aspect of the case concerns barium-based firecrackers and the evidence needed to assess them. During a hearing on September 30, a bench comprising Justices MM Sundresh and PB Varale indicated that it was inclined to consider a proposal permitting firecrackers subject to conditions. Additional Solicitor General Aishwarya Bhati, appearing for the Centre, sought time until October 15 to place the Central Pollution Control Board's report on record. She informed the court that outdoor testing of barium-based firecrackers had not yet been conducted. The testing issue matters because decisions concerning the use of particular firecracker formulations require evidence about their characteristics and potential environmental effects. Regulatory decisions must consider the available technical information and the conditions under which products may be tested, approved or used. The Central Pollution Control Board's report is therefore an important part of the material that the court is expected to consider in the ongoing proceedings.
