Delhi Court Frames Money Laundering Charges Against Yasin Malik, Six Others

A special court in Delhi has directed the framing of charges against Yasin Malik and six others under the Prevention of Money Laundering Act in a case concerning alleged foreign funding and the movement of money through Hawala channels. The case relates to allegations made by the Enforcement Directorate that foreign funds were received through different channels and subsequently routed to members of the Hurriyat leadership, including Malik. The agency has alleged that the money was connected with activities supporting a separatist agenda in Jammu and Kashmir. The court has said that, at the stage of framing charges, there is sufficient material on record to raise a strong suspicion against all seven accused. The order allows the prosecution to proceed with the Money Laundering Case.

Seven Accused Face PMLA Proceedings

Along with Yasin Malik, charges have been directed against Zahoor Ahmad Shah Watali, Abdul Rashid Sheikh, Shabir Ahmad Shah, Masarat Alam, Naval Kishore Kapoor and Trison Farms and Constructions Pvt Ltd. The proceedings are being conducted under the Prevention of Money Laundering Act. The court's finding at this stage is based on whether there is sufficient material to proceed with the case, rather than a final determination of guilt. The court had earlier observed that the material available on record created a strong suspicion against the accused for an offence under Section 3 of the PMLA, which is punishable under Section 4 of the Act. The formal process of framing charges was affected by security concerns because some of the accused could not be physically produced before the court. The court subsequently directed the Enforcement Directorate to obtain the necessary signatures from Malik and other accused who are in judicial custody.

What Is the Alleged Hawala Funding Network?

The Hawala Funding allegations are at the centre of the financial investigation. According to the Enforcement Directorate, foreign funds were allegedly transferred through a network involving cash couriers and intermediaries. The agency has alleged that some of the money was collected from the Pakistan High Commission in New Delhi and then delivered to members of the Hurriyat leadership. The ED has alleged that Yasin Malik was among the recipients of funds that were allegedly intended to support separatist and subversive activities in Jammu and Kashmir. The agency has described the alleged financial system as a network involving different channels and intermediaries through which money was transferred outside conventional banking mechanisms. These claims are part of the prosecution case and remain subject to the judicial process.

ED Alleges โ‚น8.94 Crore in Proceeds of Crime

The Enforcement Directorate has alleged that the criminal activities under investigation generated proceeds of crime amounting to approximately โ‚น8.94 crore. According to the agency, these alleged proceeds were subsequently received, transferred, concealed, possessed, acquired or used by the accused through different channels. The financial investigation therefore focuses not only on the alleged source of the funds but also on how the money was allegedly moved and used after it was received. The ED's case is linked to the underlying NIA investigation into alleged terrorist, separatist and unlawful activities in Jammu and Kashmir.

Foreign Contributions Allegedly Received During 2015-16

The ED has also relied on documents recovered during its investigation. According to the agency's case, material recovered from Ghulam Mohd Bhat, described as an accountant-cum-cashier working with Zahoor Ahmad Shah Watali, allegedly contained details concerning foreign contributions received during the 2015-16 financial year. The agency has alleged that Malik, Shabir Ahmad Shah and Masarat Alam received foreign contributions through Watali. Investigators also examined emails associated with Malik. According to the ED, those communications indicated an alleged network for raising funds abroad. The agency has alleged that these funds were intended to support the activities of the JKLF and strengthen the separatist network in Jammu and Kashmir.

Alleged Funds Linked to Yasin Malik

The financial investigation also examined specific payments allegedly received by Malik. According to the material cited by the prosecution, the NIA's second supplementary chargesheet alleged that Malik received around โ‚น15.75 lakh from Saudi Arabia in 2013. The ED has separately alleged that Malik received additional funds through Watali during the 2015-16 period. The agency has claimed that the total amount allegedly received by Malik through the channels under investigation was around โ‚น30.75 lakh. The ED has treated the alleged amounts as proceeds of crime connected with the scheduled offences in the larger investigation.

Case Originated From 2017 NIA Investigation

The present NIA Court proceedings are connected to a larger case registered by the National Investigation Agency in 2017. The original investigation concerned allegations of a broader conspiracy involving terrorist and separatist activities in Jammu and Kashmir. Various provisions of the Indian Penal Code and the Unlawful Activities (Prevention) Act were invoked in that case. The Enforcement Directorate subsequently registered its own case on June 14, 2017, to investigate the alleged laundering of proceeds generated from the scheduled offences. The ED later filed its main prosecution complaint in 2020, while a supplementary complaint filed in January 2023 named Malik as an accused in the money laundering proceedings.

Court Says Strong Suspicion Exists at This Stage

A key point in the latest development is the court's observation regarding the threshold required for framing charges. The special NIA court said that there was sufficient material on record from which a strong suspicion could arise against all seven accused. This does not mean that the court has reached a final conclusion that the accused are guilty of money laundering. At the charge-framing stage, the court considers whether the material placed before it is sufficient for the prosecution to proceed. The evidence and allegations will be examined further during the subsequent stages of the legal proceedings.

Security Concerns Affect Physical Production of Accused

The court also dealt with the practical issue of producing the accused during the proceedings. Malik and some of the other accused who are in judicial custody could not be physically produced before the court because of security concerns. The court therefore directed the Enforcement Directorate to obtain their signatures as part of the formal charge-framing process. The next hearing has been fixed for October 30, when further proceedings in the case are expected to take place.

Background of Yasin Malik's Legal Cases

Yasin Malik, who headed the banned Jammu and Kashmir Liberation Front, is already serving a life sentence following his conviction in a separate terror-funding case in 2022. The current proceedings are different in scope and focus specifically on alleged money laundering and the movement of funds that the ED says were generated through scheduled offences. The agency's financial investigation seeks to establish the alleged source of the money, the channels through which it moved and the manner in which it was allegedly used. The latest court order means that the PMLA proceedings against Malik and the other accused will continue.

Why the Money Trail Is Central to the Case

The financial trail is a key component of the prosecution's case. Investigators have examined alleged foreign contributions, cash couriers, intermediaries, documents and electronic communications while attempting to establish how the funds were allegedly collected and distributed. The ED has alleged that the money was not simply received but was subsequently routed through different channels before being used for activities that the agency associates with the wider separatist case. The court's latest order means these allegations will now be tested through the legal proceedings rather than being treated as a concluded finding.

What Happens Next?

The case will now move forward following the court's direction to frame charges. The prosecution will continue presenting its case concerning the alleged financial transactions, while the accused will have the opportunity to contest the allegations through the judicial process. The next hearing is scheduled for October 30, 2026. Until the court reaches a final decision after examining the evidence, the allegations made by the Enforcement Directorate should be understood as prosecution claims rather than established facts.
