CJP Gives Delhi Police 24 Hours to Set Jantar Mantar Protest Date

The Cockroach Janta Party (CJP) has given Delhi Police 24 hours to decide when its members can hold a peaceful demonstration at Jantar Mantar in New Delhi. Party representatives approached Parliament Street Police Station on Monday, October 12, asking the authorities to specify a date and time for the proposed protest. The party said it was willing to let the police determine the schedule but would not accept an indefinite delay in the decision. The latest development follows the police refusal to grant permission for a demonstration planned for October 10 against Chief Election Commissioner Gyanesh Kumar. The proposed protest concerns allegations of irregularities in the Special Intensive Revision (SIR) of electoral rolls and demands for accountability from the Election Commission. These allegations remain contested and should not be treated as established findings. According to reports published on October 12, CJP leaders Ashutosh Ranka and Saurav Das visited the police station to press their demand. They warned that if the authorities failed to provide a date within 24 hours, the party would announce another protest call.

Why Has CJP Given Delhi Police an Ultimatum?

The immediate dispute centres on permission for a demonstration at Jantar Mantar, a prominent protest location in the national capital. CJP wants to organise a peaceful gathering against the Election Commission's handling of electoral roll revisions. Speaking to the media, party spokesperson Saurav Das argued that police authorities routinely ask organisers to approach them at least 10 days before a planned demonstration. He said the party was now leaving the choice of date and time to the police itself. The party's position is that authorities should provide a clear response instead of leaving its application unresolved. Ashutosh Ranka also expressed hope that the police would specify a suitable date. The leaders said they would consider announcing another demonstration if no response arrived within the deadline. The ultimatum marks another stage in the disagreement between the party and the authorities over how and where the proposed gathering can take place.

Why Did Delhi Police Deny Permission for the October 10 Protest?

Delhi Police refused permission for the proposed October 10 demonstration, citing the short notice given by the organisers, alleged non-compliance with conditions during an earlier protest, and concerns about public safety, traffic management and law and order. Joint Commissioner of Police Nupur Prasad said the application had been received on October 7, only three days before the proposed event. According to the police, organisers were expected to submit such requests at least 10 days in advance. The authorities also referred to restrictions imposed in the New Delhi district and the need to manage a potentially large gathering. Police maintained that arrangements had to account for public movement, security requirements and the possibility of disruption. CJP, meanwhile, has continued to press for an opportunity to demonstrate peacefully. The central question is whether the authorities will provide an alternative date and under what conditions the gathering could be permitted.

What Is the Protest Against Chief Election Commissioner Gyanesh Kumar About?

The proposed CJP protest is connected to objections raised by the party and other groups regarding the Special Intensive Revision of electoral rolls. The SIR exercise involves reviewing voter lists to update electoral records. Critics have raised concerns about the removal of names and the possibility that eligible voters could be affected. The Election Commission's electoral roll process has become the focus of political disagreement, with opposition groups seeking greater accountability and transparency. CJP has called for action against Chief Election Commissioner Gyanesh Kumar, including demands for his resignation. The party's protest plans are part of a wider series of demonstrations in Delhi concerning electoral processes. However, allegations of irregularities do not by themselves establish wrongdoing. Assessing individual claims requires evidence, official responses and relevant legal or administrative findings.

Security Restrictions and Detentions in Delhi

The proposed gathering has taken place against a backdrop of heightened security in the capital. Ahead of the October 10 demonstration, police introduced restrictions and increased security arrangements around sensitive locations. Authorities were concerned about crowd management, traffic movement and the enforcement of prohibitory orders. Reports also described the detention of CJP leaders and other demonstrators as police attempted to prevent the unauthorised gathering. These measures added to the dispute between organisers and law enforcement agencies. The party has argued that it should be allowed to express its position through a peaceful demonstration, while police have pointed to procedural requirements and public-order considerations. The situation has renewed attention on the practical challenges involved in organising demonstrations in central Delhi, particularly when large crowds and politically sensitive demands are expected.

Is Peaceful Protest a Constitutional Right in India?

The right to protest is closely linked to the fundamental freedoms guaranteed by the Indian Constitution. Article 19(1)(a) protects freedom of speech and expression, while Article 19(1)(b) guarantees the right to assemble peacefully and without arms. These rights are not absolute. The Constitution permits reasonable restrictions on specified grounds, including public order and the sovereignty and integrity of India. Authorities can regulate public gatherings and impose lawful conditions to protect safety and maintain order. At the same time, decisions concerning demonstrations must be assessed within the constitutional framework. The existence of regulatory powers does not mean that every peaceful gathering can automatically be prohibited, nor does the constitutional right to assemble remove the need to comply with applicable laws and lawful directions.
