The Central government informed the Supreme Court that it is committed to ensuring that genuine students who participated in protests against alleged paper leaks are not subjected to criminal proceedings. However, it clarified that individuals accused of serious criminal offences will not receive similar relief.

The assurance came during a hearing on petitions related to the violence that occurred during the 'Sansad Chalo' march on July 20.

Government Working on FIR Withdrawal

Appearing for the Centre, Solicitor General Tushar Mehta told the court that discussions had taken place with the petitioners regarding the withdrawal or closure of FIRs registered against student protesters.

He said the government does not want legal action against genuine students and is taking necessary steps to resolve the issue. However, he stressed that people accused of serious criminal offences cannot claim protection by associating themselves with the student protests.

Supreme Court Seeks Separation of Cases

The bench led by the Chief Justice of India (CJI) directed that FIRs should first be classified into two categories—those involving genuine student protesters and those concerning individuals accused of serious criminal offences.

The court clarified that references to "criminal history" should apply only to those facing grave charges, such as murder or other serious offences, and not to people involved in minor cases or previous political demonstrations.

Concerns Raised Over Police Action

During the hearing, petitioners questioned the use of force by police during the protests and sought an independent investigation into allegations of excessive action against demonstrators.

The Supreme Court observed that police officials would not be shielded if evidence of misconduct emerged. The bench said it would consider whether an SIT or a committee headed by a retired judge should examine the allegations.

Privacy Concerns Over Facial Recognition

Petitioners also raised concerns about the alleged use of facial recognition technology during the protests, claiming that large-scale facial data was collected without consent.

The Centre informed the court that identification was carried out through both facial recognition technology and field verification. According to the government, details of 2,738 individuals were collected, with serious criminal cases registered against some of them.

Next Hearing Scheduled for August 18

The Supreme Court fixed the next hearing for August 18, directing all parties to file their responses before the matter is heard again.

The court is expected to consider the scope of any independent investigation and review the government's progress on the issue of FIRs against student protesters.
