Supreme Court: Refusal to Marry Alone Is Not Abetment of Suicide

The Supreme Court of India has quashed criminal proceedings against six people accused of abetting a woman's suicide after her alleged partner reportedly refused to marry her. The court observed that a refusal to marry following a consensual relationship cannot, by itself, establish the offence of abetment of suicide. The ruling came in a case involving a woman who had reportedly lived with the first accused for around three months. Her family alleged that he declined to marry her and that she subsequently died by suicide. The court examined the allegations and concluded that the material presented did not establish the necessary instigation by the accused. The decision highlights the distinction between the emotional consequences of a relationship ending and the legal requirements for establishing criminal responsibility. It also explains why allegations must be assessed against the relevant legal standards before criminal proceedings can continue.

Supreme Court Explains Why the Case Could Not Continue

A Bench comprising Justices J.B. Pardiwala and K. Vinod Chandran set aside the proceedings pending before the II Additional Senior Civil Judge-cum-Additional Chief Judicial Magistrate in Kushaiguda, Medchal-Malkajgiri district of Telangana. The proceedings arose from allegations that six individuals had contributed to the circumstances leading to the woman's death. After considering the allegations, the Bench found insufficient material to establish that the accused had instigated her to take her own life. The court made it clear that the reported sequence of events, including the refusal to marry and the subsequent death, was not enough on its own to establish the offence.

How the Relationship Led to the Legal Dispute

According to the prosecution, the woman had been living at the first accused's house for approximately three months. The relationship was described as consensual, and the allegations indicated that members of his family were aware of it. The woman's siblings later alleged that the first accused refused to marry her and that she died by suicide following the refusal. Her sister's statement formed the basis of the First Information Report (FIR) that initiated the criminal case. The prosecution also raised allegations concerning the conduct of other people connected to the first accused. These allegations formed part of the circumstances examined by the court. However, allegations made during an investigation do not automatically establish criminal guilt. The court assessed whether the material available could support the specific charge of abetment of suicide against the accused.

What the Supreme Court Said About Refusal to Marry

The Bench observed that people respond differently to the end of a relationship and that a breakup followed by suicide cannot automatically be treated as proof of criminal instigation. In its assessment, the court found no sufficient material showing that the accused intended to drive the woman to suicide or that the necessary knowledge could be attributed to them simply because the marriage did not take place. The judges considered the prosecution's allegations even on the assumption that the informant's account was accepted in full. They concluded that the central allegation was that the first accused had refused to marry the woman, after which she died by suicide. The court found that this sequence, without sufficient material establishing the required elements of the offence, could not sustain the prosecution.

Court Examines the Role of Instigation

A central question in the case was whether the conduct attributed to the accused amounted to instigation that could legally be linked to the woman's death. The Bench found that the available material did not establish such instigation. It also observed that the refusal to marry could not, on the facts presented, be treated as conduct intended to drive the woman to suicide. The court therefore concluded that the criminal case could not be sustained merely on the allegations described in the record. In cases involving abetment of suicide, courts examine the alleged conduct and the evidence to determine whether the requirements of the relevant criminal law are satisfied. The precise assessment depends on the facts and applicable legal provisions in each case. The ruling reinforces the need to distinguish between an event that precedes a suicide and conduct that legally amounts to abetment. The timing of events may form part of the evidence, but timing alone does not establish criminal responsibility.

Supreme Court Raises Questions About the Circumstances

The Bench also questioned aspects of the circumstances surrounding the relationship, including why the woman had been taken away from the first accused's house when the relationship was described as consensual and reportedly known to his family. The court further noted that the woman had contacted her eldest sister before her death and informed her that the first accused had refused to marry her. According to the order, the woman also communicated her intention to end her life. The Bench observed that no steps had been taken to prevent the threatened suicide. These observations formed part of the court's examination of the circumstances described in the case. They should not be interpreted as a general finding that every family member who receives such a warning is automatically criminally responsible for what follows.

Criminal Proceedings Against Six Accused Quashed

After evaluating the allegations, the Supreme Court quashed the proceedings in Sessions Case No. 101 of 2024. The order brought the prosecution against the six accused to an end in the case before the court. The Bench also issued directions concerning their custody and bail status. It ordered that any accused who remained in custody should be released immediately unless their detention was required in another case. For those already released on bail, their bail bonds were ordered to stand cancelled. The ruling was based on the court's conclusion that the allegations, even when considered in their entirety, did not establish the required basis for prosecuting the accused for the woman's suicide.

What This Ruling Means for Similar Cases

The judgment draws attention to the importance of evidence in criminal cases involving relationship disputes and deaths by suicide. A person's decision to end a relationship or decline marriage is not, by itself, sufficient to establish the offence of abetment. Investigators and courts must examine the conduct alleged, the surrounding circumstances and whether the legal requirements of the offence are supported by the material available. At the same time, the decision should not be read as dismissing the emotional distress that can follow the breakdown of a relationship. The court's task in this case was to determine whether the prosecution against the six accused could legally proceed on the allegations presented. For families affected by suicide, the case also illustrates the importance of taking statements about self-harm seriously and seeking timely assistance when someone may be at risk. Such situations require urgent attention and support, regardless of whether criminal liability is ultimately established.
