Gujarat High Court: Marriage Registration Alone Cannot Validate a Hindu Marriage

Gujarat High Court has ruled that registering a marriage or obtaining a marriage certificate alone does not make a Hindu marriage legally valid if the essential religious rites and ceremonies required under the Hindu Marriage Act have not been performed.

The court observed that a Hindu marriage is a sacred institution governed by law as well as customary religious practices. It emphasized that registration is meant to serve as evidence of a marriage, but it cannot replace the mandatory rituals prescribed under the law.

Court Sets Aside Family Court Order

The ruling came while hearing an appeal filed by a UK-based man who challenged the validity of an alleged marriage.

According to court records, the man argued that although a marriage certificate had been issued, no Hindu marriage ceremony had ever taken place, and no customary rituals were performed. He also claimed the parties had never lived together as husband and wife.

The Gujarat High Court set aside an earlier family court order and held that the absence of essential ceremonies meant the marriage could not be treated as legally valid under Hindu law.

Section 7 of the Hindu Marriage Act Explained

The High Court referred to Section 7 of the Hindu Marriage Act, 1955, which states that a Hindu marriage must be solemnized according to the customary rites and ceremonies of either party.

Where the ceremony of Saptapadi (the seven sacred steps around the holy fire) is part of those customs, the marriage becomes complete only after the seventh step is taken.

The judges noted that these ceremonies are not merely symbolic but form the legal foundation of a valid Hindu marriage.

Marriage Certificate Cannot Replace Rituals

The court clarified that a marriage certificate only records that a marriage has been registered. It does not automatically prove that a legally valid Hindu marriage was solemnized if mandatory customs and ceremonies were never performed.

According to the judgment, registration cannot cure the absence of the basic legal requirements laid down under the Hindu Marriage Act.

Court Calls Marriage a Sacred Institution

During its observations, the Gujarat High Court stated that marriage is not merely an occasion for "song and dance" but a sacred institution carrying legal, social, and religious significance.

The judges emphasized that Hindu marriage ceremonies are intended to establish the marital relationship through customary religious practices that have legal recognition under Indian law.

Legal Significance of the Judgment

The judgment reinforces that both legal registration and the performance of essential customary ceremonies play different roles in Hindu marriages.

While registration serves as documentary proof, it does not substitute the solemnization of marriage through legally recognized Hindu rituals where such ceremonies are required by custom.

The ruling is expected to influence future matrimonial disputes involving the validity of marriages under the Hindu Marriage Act and highlights the importance of complying with both statutory requirements and customary religious practices.
