Delhi High Court Denies Interim Relief to Raghav Chadha in Personality Rights Case

Delhi High Court has refused to grant interim relief to Aam Aadmi Party (AAP) Rajya Sabha MP Raghav Chadha in his personality rights case, observing that there was no prima facie violation of his personality rights at this stage of the proceedings.

The court also noted that it had already directed the removal of five social media posts previously found to be prima facie defamatory, but declined to order the removal of the remaining content.

Court Says No Immediate Grounds for Interim Protection

The matter was heard by Justice Subramonium Prasad, who observed that the remaining social media content did not appear objectionable on the face of it.

The court stated that the issue of personality rights was not clearly established at this stage and therefore found no basis to issue a blanket interim order restricting or removing all remaining online content.

Five Posts Already Removed

During the hearing, the High Court recalled that it had earlier ordered the removal of five specific social media posts and documents that were considered prima facie defamatory.

However, the court held that the remaining material did not warrant similar action based on the evidence currently available.

As a result, no further interim directions were issued.

What Is the Case About?

Raghav Chadha approached the Delhi High Court alleging that his name, photographs, and identity were being used without authorization on social media platforms.

In his petition, he sought protection of his personality rights and requested the court to:

  • Remove objectionable social media posts.
  • Prevent unauthorized use of his name, image, and identity.
  • Safeguard his personality rights from misuse.
  • Court Highlights Balance Between Rights and Free Speech

The High Court also emphasized the importance of maintaining a balance between freedom of speech and an individual's right to protect their reputation.

The court observed that criticism of politicians is a normal feature of a democratic society and that not every critical statement amounts to defamation.

It added that judicial intervention is appropriate only when content is clearly unlawful or defamatory on its face.

Personality rights are legal protections that prevent the unauthorized use of a person's name, image, likeness, voice, or identity, particularly for commercial exploitation or improper purposes.

Courts may intervene if an individual's identity is misused in violation of these legal protections.
